Preamble
1 - The website pebbly.fr is published by LA BRIGADE DE BUYER, a simplified joint-stock company with a single shareholder and a share capital of €7,500.00, whose registered office is located in Bordeaux (15 rue Roger Ducasse, 33200 Bordeaux), registered under the unique identification number RCS 451 208 359 ("LA BRIGADE DE BUYER").
LA BRIGADE DE BUYER is the author of the sales offer relating to the products presented on its website: pebbly.fr.
Scope of the General Terms and Conditions of Sale - These General Terms and Conditions of Sale apply to all sales concluded between LA BRIGADE DE BUYER - SIRET No. 451 208 359 000 54 and its Customers, regardless of any clauses that may appear on the Customer's commercial documents or general terms and conditions of purchase.
These General Terms and Conditions of Sale, together with the order form and the order confirmation, constitute the sales contract between the customer and LA BRIGADE DE BUYER relating to the sale of the ordered products. Any order placed on the website requires the customer to first accept these General Terms and Conditions of Sale in their entirety and without reservation. If the customer disagrees with these General Terms and Conditions of Sale, they must not use the website.
LA BRIGADE DE BUYER reserves the right to adapt or modify these General Terms and Conditions of Sale at any time and without prior notice. Such adaptations and modifications shall apply to all orders placed after these adaptations and/or modifications.
In the event of modification, the General Terms and Conditions of Sale applicable to the customer's order are those that were online and accepted by the customer on the day the order was placed.

Article 1 - Purpose
These General Terms and Conditions of Sale define the rights and obligations of LA BRIGADE DE BUYER and the Customer within the framework of the sale of Products by LA BRIGADE DE BUYER on the website or through the Customer Service of the Website provided by LA BRIGADE DE BUYER.
Any use of the Website and any order of one or more products through the Website implies the full and unconditional acceptance of these General Terms and Conditions of Sale.
Article 2 - Products
Among all the products available on the pebbly.fr website, LA BRIGADE DE BUYER sells the following products: Bamboo kitchen utensils, kitchen scales, bread boards and chopping boards, glass storage containers and hob covers.
This list is not exhaustive and only includes the products we have chosen to feature.
Article 3 – Creating an Account
To order Products on the Website, the Customer must create an account by providing the information requested in the registration form.
For this purpose, the Customer declares that they provide complete and accurate personal information allowing their precise identification in all circumstances. Any fictitious or defamatory personal information may result in the closure of the Customer's account and the cancellation of their Order.
The Customer is responsible for all actions carried out on the Website using their username and password. Any registered user of the Website shall be bound by any Order placed using their login credentials, subject to the right of withdrawal set out in Article 10.4.
Article 4 – Ordering Procedure
4.1. The Customer may place an Order, in French, directly on the Website after entering their username and password.
4.2. While browsing the various sections of the Website, the Customer may add the Products of their choice to their shopping cart by clicking on the "Buy" button. At any time and until the Order is confirmed, the Customer may change their mind, modify quantities, or remove one or more selected Products.
Each of the steps required to complete the sale is described on the Website.
Information about the Products and Orders may also be obtained or placed by the Customer, in French or English, directly through Customer Service at [email protected].
For any request for information or any Order, the Customer shall bear the telecommunications costs associated with Internet access and use of the Website, or with contacting the Website Customer Service.
4.3. In accordance with the provisions of Article 1369-5 of the French Civil Code, the Customer will have the opportunity to review the details of their Order and its total price and, where appropriate, correct or modify it before finally confirming the Order to express their acceptance.
LA BRIGADE DE BUYER shall not be held liable for any data entry errors made by the Customer, nor for any consequences resulting from such errors, including delays or delivery mistakes. In such cases, any additional shipping costs resulting from reshipment shall be borne by the Customer.
Validation of the Order by the Customer through the "double-click" process constitutes acceptance of the prices and characteristics of the Products purchased by the Customer.
Article 5 – Order Procedure – Confirmation
5.1. Once the Order has been validated by the Customer in accordance with Article 3.4, LA BRIGADE DE BUYER shall send the Customer an order confirmation email acknowledging receipt of the Order and summarizing all related information as soon as possible.
5.2. The Order shall only be considered final once LA BRIGADE DE BUYER has sent the Customer the confirmation email referred to in Article 4.1, and the sale of the Product(s) shall only be deemed completed upon receipt of the corresponding payment from the Customer.
Article 6 – Ordering Procedure – Product Prices
6.1. The prices of the Products displayed on the Website are expressed in Euros, including all applicable taxes. Product prices do not include the Customer's contribution to logistics preparation costs (handling and shipping) and delivery charges, which remain the responsibility of the Customer. The total amount of these charges is communicated to the Customer either during their visit to the Website or when contacting Customer Service, before the Customer confirms their Order.
Article 7 – Payment
7.1. Scope of payment – The price of the Products, together with the logistics preparation and delivery costs, must be paid in full by the Customer when placing the Order.
The Customer also undertakes to pay, where applicable, directly to the customs broker or carrier, any customs duties, VAT, or other taxes payable upon importation of the Products into the country of delivery.
7.2. Payment methods – Payment for the Order may be made by the Customer by credit card through a secure payment environment using the methods offered on the Website.
A payment order made by credit card cannot be cancelled. Payment of the Order by the Customer is irrevocable, without prejudice to the Customer's right of withdrawal.
For Orders placed on pebbly.fr, the Customer confirms and guarantees that they are the holder of the payment card used and that the card provides access to sufficient funds to cover payment of the Order.
The Website uses one of the most advanced security systems available to protect all sensitive payment information. LA BRIGADE DE BUYER never has access to confidential payment details, which is why this information is requested each time the Customer places an Order.
Article 8 – Order Preparation and Delivery
Preparing your order
Product availability & Order preparation
Except in cases of force majeure or during periods when the online store is closed, which will be clearly announced on the Pebbly website homepage, shipping times shall, subject to product availability, be those indicated below. Shipping times begin from the date on which the order is registered.
Order preparation time:
Mainland France: orders are prepared within 3 business days from the day following the date on which the consumer places the order, regardless of the shipping method selected.
In the event of a delay, LA BRIGADE DE BUYER shall not be held liable, regardless of the reason. Consequently, the Customer shall not be entitled to claim any compensation of any kind from LA BRIGADE DE BUYER.
If an ordered product is unavailable, the consumer will be informed as soon as possible and will have the option to cancel the order. The consumer may then choose either to receive a refund of the amounts paid within no more than 30 days of payment or to exchange the product.
Shipping your parcel
8.1. Place of delivery – As a general rule, Products will be delivered, once payment has been recorded, to the delivery address provided by the Customer during the ordering process. An email will be sent to the Customer to confirm shipment of the Products.
No deliveries are made to campsites, hotels, poste restante addresses or post office boxes. Products are delivered to the address provided by the Customer on the order form, and it is the Customer's responsibility to ensure its accuracy. Any parcel returned to the sender due to an incorrect or incomplete delivery address will be reshipped at the Customer's expense.
Ordered Products are delivered by DPD or by an independent carrier, depending on the size and weight of the Products ordered and at the sole discretion of LA BRIGADE DE BUYER.
LA BRIGADE DE BUYER delivers orders to the following countries and territories: France, Belgium, Germany, Spain, Austria, Ireland, Italy, Luxembourg, the Netherlands and Portugal.
The Customer may also choose to have the Products delivered to a third party whose permanent residence is located in mainland France.
8.2. Delivery charges – Delivery costs vary depending on the destination country.
- €9.90 incl. VAT for home delivery in France, Belgium, Germany, Austria, Belgium, Spain, Ireland, Italy, Portugal, Luxembourg and the Netherlands.
- €5.95 incl. VAT for delivery to a pickup point or workplace within France.
Free delivery is available for Mainland France only and applies when the total order value is equal to or greater than €59.00.
8.3. Delivery times – Parcels are generally dispatched within 48 to 72 hours after payment has been received. They are shipped via DPD with a tracking number and delivered without signature. Once your order is ready for shipment, you will receive an email containing your parcel tracking number.
In all cases, the maximum delivery time is thirty (30) business days from the date the Product is ordered, unless otherwise specified to the Customer before the Order is placed.
Shipping costs include preparation, packaging, and postage fees. These charges are fixed. We recommend grouping all your items into a single order. We are unable to combine two separate orders, and shipping charges will apply to each order individually. Your parcel is shipped at your own risk; however, particular care is taken when packaging fragile items.
If your parcel arrives damaged, please contact Customer Service at [email protected], providing details of the issue along with a photograph of the parcel.
If, after your order has been dispatched, you fail to collect your parcel or the delivery address provided is incorrect, DPD will return the parcel to us. Upon receipt and inspection, we will refund your order excluding shipping costs.
To keep shipping costs as low as possible, products of small or medium size are mainly shipped via DPD. This economical service delivers within 48 hours throughout mainland France. If you are absent from the original delivery address when the carrier attempts delivery, you may collect your ordered products from the post office nearest to the delivery address.
Returns
Customers have a period of fourteen (14) clear days from the delivery date of their order to return new products (never used and in their original packaging), at their own expense, after obtaining return authorization from the Customer Service department of pebbly.fr.
pebbly.fr will refund the Customer for any amounts already paid corresponding to the returned product(s), less any applicable shipping charges.
Article 9 – Product Conformity, Warranty and Right of Withdrawal
9.1. Product conformity
The legal guarantee of conformity referred to in Articles L.211-4 to L.211-13 of the French Consumer Code, as well as the warranty against hidden defects referred to in Articles 1641 to 1648 and 2232 of the French Civil Code, shall apply in accordance with the law.
In the event of a claim under the legal guarantee of conformity, the consumer:
- Benefits from a period of two years from the date of delivery of the goods to take action;
- May choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.211-9 of the French Consumer Code.
The legal guarantee of conformity applies independently of any commercial warranty. If the consumer decides to invoke the warranty against hidden defects of the goods sold, they may choose either to cancel the sale or to request a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
Article 10 – Conditions of Use of the Products
10.1. Before placing any Order and before using any Product, the Customer must read all the information provided on the Website, obtain information about the characteristics and components of the Products, and ensure that they are compatible with the intended use.
The prices of the Products do not include the Customer's contribution to logistics preparation costs (processing and shipping) and delivery charges, which remain the responsibility of the Customer. The total amount of these charges is communicated to the Customer either when visiting the Website or when contacting Customer Service before confirming the Order.
Article 11 – Liability
11.1. The Products presented on the Website comply with current French legislation and with the standards applicable in France.
LA BRIGADE DE BUYER undertakes solely to comply with the legal provisions applicable in France. No regulations specific to the country of delivery and/or consultation of the Website may be enforced against LA BRIGADE DE BUYER.
The Customer is solely responsible for complying with the regulations applicable in their country of residence or in the country of destination of the Products. It is the Customer's responsibility to consult the relevant local authorities regarding any import, export or usage restrictions applicable to the Products they intend to order from the Website.
11.2. The service provided by LA BRIGADE DE BUYER is limited to supplying the Products under the conditions described in these General Terms and Conditions of Sale. Under no circumstances shall LA BRIGADE DE BUYER be held liable for advice, recommendations or instructions for use of the Products provided by the manufacturers on the Website or in the Product instruction manuals.
Article 12 – Electronic File
Protection of Personal Data
12.1. In order to process Orders, LA BRIGADE DE BUYER processes the Customer's personal data identified as mandatory in the forms available on the Website.
12.2. LA BRIGADE DE BUYER undertakes to respect the confidentiality of the personal data provided by Customers on the Website and to process such data in accordance with the French Data Protection Act of January 6, 1978, as amended and currently in force.
The database created by LA BRIGADE DE BUYER has been declared to the CNIL in accordance with the requirements of the French Data Protection Act.
12.3. The Customer's personal data is collected and processed by LA BRIGADE DE BUYER for the purpose of processing Orders.
12.4. The Customer may exercise their individual right of access to the file, their right to object, rectify or delete their personal data either by modifying their personal information themselves in the "My Account" section under "Help", or by sending their request to LA BRIGADE DE BUYER (indicating their email address, surname, first name and postal address) by email to [email protected].
12.5. The Website has been designed to pay particular attention to the Customer's needs. Cookies are therefore used to record the Customer's visit to the Website for the purpose of creating their shopping cart.
Cookies will be stored on the Customer's hard drive for six (6) months.

Article 13 – Intellectual and Industrial Property Rights
All elements published on the Website, including sounds, images, photographs, videos, texts, animations, software, graphic charters, utilities, databases and other underlying technologies are protected by the provisions of the French Intellectual Property Code and belong to LA BRIGADE DE BUYER.
The LA BRIGADE DE BUYER trademark, together with all figurative or non-figurative trademarks and, more generally, all other trademarks, illustrations, images and logos appearing on the Products, their accessories or packaging, whether registered or not, are and shall remain the exclusive property of LA BRIGADE DE BUYER, with the exception of the rights relating to the product visuals, trademarks and logos belonging to the suppliers of the Products presented on the Website.
Any total or partial reproduction, modification or use of these trademarks, illustrations, images or logos, for any purpose and on any medium whatsoever, without the prior written consent of LA BRIGADE DE BUYER, is strictly prohibited.
Except with its prior request, LA BRIGADE DE BUYER prohibits the creation of any hyperlink directing users to the Website. Any Customer wishing to place a link on their personal website pointing directly to the Website homepage must first obtain the express authorization of LA BRIGADE DE BUYER.
Article 14 – Applicable Law – Jurisdiction
These General Terms and Conditions of Sale are governed by French law. Only the French version of these General Terms and Conditions of Sale shall be deemed authentic.
In the event of any dispute arising in connection with the Order, the delivery of the Products or, more generally, the performance of the sale, the Customer shall have the opportunity, before initiating any legal proceedings, to seek an amicable solution, in particular with the assistance of a consumer association or any other advisor of their choice.
Any dispute arising from the interpretation or performance of these General Terms and Conditions of Sale and their consequences shall be submitted to the competent courts, unless an amicable agreement has first been reached between the parties.
These General Terms and Conditions of Sale also apply to any user of the Website who has not placed an Order, particularly with regard to Articles 11 to 15.
